How can I dissolve my civil partnership?

A court order similar to the one that deals with divorce is required for dissolution of a civil partnership. The agreement can be made if either partner can successfully show that the relationship has broken down. This agreement may only be made at least 12 months after the beginning of the partnership.

There are four conditions that a partner can allege the relationship has broken down using. These are:

  • One partner in the relationship has behaved unreasonably
  • It has been agreed in writing that the partnership should be dissolved, and both parties have been separated for two years
  • One partner has been deserted for two years by the other
  • Both parties have been separated for five years are longer

These are the same conditions that are required to grand a divorce in England & Wales. As adultery is assumed not to be able to be committed in a same-sex relationship by law, then this cannot be used as a reason for getting a divorce. It should be noted that this falls under unreasonably behaviour and can still be used as a reason for dissolution, but it will not be known as adultery.

The Court is in charge of giving the Orders that relate to how any children will be cared and provided for, as well as any contact orders regarding the children. Like divorce, financial provision can be made by the court for the care of children in a number of ways, such as:

  • Pension
  • Lump sum
  • Maintenance Orders
  • Property transfer

In the event of death, those in a civil partnership are afforded the same rights are those who are married.
